Picklelytics Terms & Conditions
These Terms & Conditions ("Terms") constitute a legally binding agreement between NEURAL DASH SOLUTIONS PLT, a limited liability partnership registered in MALAYSIA under registration number LLP0037435-LGN ("Picklelytics", "we", "us", or "our"), and you ("you" or "user").
These Terms govern your access to and use of Picklelytics' websites, mobile applications, and related services (collectively, the "Services").
By accessing, registering for, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and the Picklelytics Privacy Policy. If you do not agree, you must not access or use the Services.
1. Eligibility and Account Registration
You must be:
• At least 13 years old, or
• The minimum age required under applicable local law, to use the Services.
You are responsible for:
• Maintaining the confidentiality of your account credentials
• All activity conducted under your account
Picklelytics may suspend or terminate accounts that violate these Terms or applicable law.
2. Description of the Services
Picklelytics provides AI-powered tools that may include:
• Video upload and storage
• Automated segmentation of serves, rallies, and highlights
• Performance analysis and visualizations
• User-initiated competitive comparisons
• AI-generated visual effects optimized for social sharing
The Services are provided for informational and entertainment purposes only and do not constitute professional coaching, medical, or fitness advice.
3. User Content
3.1 Ownership of Original Content
You retain ownership of any videos or other content you upload to the Services ("User Content").
By uploading User Content, you grant Picklelytics a non-exclusive, worldwide, royalty-free license to host, store, process, analyze, modify, and display such content solely for the purpose of providing, maintaining, and improving the Services.
3.2 User Representations
By uploading User Content, you represent and warrant that:
• You have the legal right to upload the content
• Any identifiable individuals appearing in the content have consented to being recorded and analyzed
• The content does not infringe any third-party rights or violate applicable law
You are solely responsible for User Content and any claims arising from it.
4. AI-Generated Outputs and Segmented Content
The Services may generate derivative works from User Content, including but not limited to:
• Segmented clips (e.g. serves, rallies)
• Highlights
• Visual overlays, effects, and annotations
• Performance metrics and metadata (collectively, "AI Outputs").
4.1 Ownership of AI Outputs
To the extent permitted by law:
• Picklelytics owns all rights, title, and interest in the AI-generated elements of the AI Outputs
• Where ownership is not recognized, you grant Picklelytics a perpetual, irrevocable, worldwide license to use, reproduce, modify, distribute, and display such AI Outputs
This does not transfer ownership of the underlying raw footage.
4.2 License Back to Users
Picklelytics grants you a non-exclusive, royalty-free, worldwide license to use, download, and share AI Outputs for personal, social, and non-commercial purposes, subject to these Terms.
5. Competitive Analysis Features
The Services may allow you to compare performance data derived from User Content with other matches, players, or aggregated datasets.
You acknowledge that:
• Competitive analysis is initiated by users
• Picklelytics does not independently identify or profile non-users
• Outputs are informational, non-deterministic, and may contain inaccuracies
Picklelytics reserves the right to limit, modify, or disable competitive analysis features at its discretion.
6. Acceptable Use
You agree not to:
• Upload content without required consent
• Use the Services for surveillance, harassment, or unlawful profiling
• Attempt to identify or deanonymize non-users
• Reverse engineer, scrape, or misuse AI systems
• Use the Services for unauthorized commercial exploitation
Picklelytics may suspend or terminate access for violations.
7. Fees, Subscriptions, and Payments
Certain features may require payment or a subscription. Unless otherwise stated:
• Fees are non-refundable
• Subscriptions renew automatically until canceled
• Pricing, features, and availability may change with notice
7.1 Promotional Offers and Credits
Picklelytics may, at its sole discretion, offer promotional benefits, including free trials, discounts, promotional credits, or pre-awarded usage credits ("Promotional Credits").
Unless otherwise expressly stated by Picklelytics in writing:
• Promotional Credits have no cash value
• Promotional Credits are non-transferable and non-refundable
• Promotional Credits may be subject to expiration dates
• Promotional Credits may be modified, suspended, or withdrawn at any time, with or without notice
• Promotional Credits may be limited to specific features, usage caps, or time periods
Picklelytics reserves the right to revoke Promotional Credits if:
• These Terms are violated
• Fraud, abuse, or misuse is suspected
• Credits were granted in error
• The Services or pricing model change
Unused Promotional Credits expire automatically upon:
• Expiration of the promotional period
• Account termination
• Conversion to a paid subscription, unless otherwise stated
8. Third-Party Services
The Services may integrate with or link to third-party platforms, including social media services.
Picklelytics is not responsible for third-party content, services, or policies. Your use of third-party services is governed by their respective terms.
9. Privacy
Your use of the Services is subject to the Picklelytics Privacy Policy, which describes how personal data is collected, processed, and protected.
10. Termination
You may stop using the Services at any time.
Picklelytics may suspend or terminate your access:
• For violation of these Terms
• For legal, security, or operational reasons
• To protect the integrity of the Services
Termination does not affect accrued rights or obligations.
11. Disclaimers
The Services are provided "as is" and "as available."
Picklelytics makes no warranties regarding:
• Accuracy or reliability of AI-generated outputs
• Fitness for a particular purpose
• Uninterrupted or error-free operation
Use of the Services is at your own risk.
12. Limitation of Liability
To the maximum extent permitted by law, Picklelytics shall not be liable for:
• Indirect, incidental, or consequential damages
• Loss of data, content, or profits
• Reliance on AI-generated outputs
Total liability shall not exceed the amount paid by you to Picklelytics in the preceding 12 months.
13. Indemnification
You agree to indemnify and hold harmless Picklelytics from claims arising out of:
• Your User Content
• Your violation of these Terms
• Your misuse of the Services
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of MALAYSIA, without regard to conflict-of-law principles.
Disputes shall be resolved exclusively in the courts of MALAYSIA, unless otherwise required by applicable law.
15. Changes to These Terms
Picklelytics may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance of the revised Terms.
